About the Drain Cover Recall

May 31, 2011

Attention pool, spa, and wader owners:

As you are aware, the CPSC recently issued a recall of several of the drain covers that had previously been deemed compliant with the new VGB State and Federal laws.  While this issue has been in deliberation for many months, the actual listing of the covers affected had not been clarified until the formal recall notice.  We are pleased to say that out of the several thousand retrofits we performed, based on the data currently released by the CPSC regarding the recall, none of the swimming pools, and only a very few of the spas and waders will be impacted by this recall.  We will be working with the individual Property Managers and drain cover manufacturers over the next several weeks and months to determine which specific spas and waders are affected, and the next steps to take to comply with the recall.  Currently, neither the CPSC nor the County Health Departments have planned the closure of bodies of water that are VGB compliant and AB1020 forms have been filed, but have recalled drain covers installed.  And neither the CPSC nor the County Health Department has issued a formal timeframe for “recall compliance”.  One additional note of importance related specifically to cost; the recall documents from the CPSC do indicate that the replacement costs for labor and new compliant covers will be borne by the cover manufacturers, but only if the replacement is coordinated through the manufacturer prior to actual replacement.  Additional costs for new permit fees at the County Health Departments are still being discussed and reviewed.  More information to come next week as we receive greater clarification from the CPSC and the drain cover manufacturers.
